1. Introduction

These Terms and Conditions (this “Agreement”) apply to all users (“you”, “Member”) who access or use the CosmicTalks website, mobile experience, accounts, free astrology tools, AI guidance and related consultation services (the “Platform” / “Sites”) available at https://thecosmictalks.com.

The Sites are operated by CosmicTalks. By using any part of the Platform you agree to be bound by this Agreement. If you do not agree to any clause, you must stop using the Sites immediately.

YOU AFFIRM THAT YOU ARE AT LEAST 18 YEARS OF AGE AND COMPETENT UNDER LAW TO ENTER INTO A BINDING CONTRACT.

CosmicTalks may modify this Agreement at any time for legal compliance or legitimate business reasons. We will make reasonable efforts to notify you of material changes. Continued use of the Platform after changes means you accept the updated Agreement.

2. Definition of services

CosmicTalks provides a digital astrology platform that may include birth chart / kundli tools, gun milan, horoscope, panchang and muhurat information, calculators, learning content, AI Guru chat, account features (saved charts, notes), and optional human consultations via WhatsApp, call or email.

Content made available via the Platform

You are solely responsible for every transaction and request under your account. Consultants or experts (where available) are not employees, agents or representatives of CosmicTalks unless expressly stated in writing, and CosmicTalks assumes no responsibility for their acts, omissions or advice.

CosmicTalks makes no guarantee that the Platform will always be available, error-free or fit for your expectations; or that any calculation, interpretation or advice will be accurate, complete or suitable for your needs.

3. Astrology, AI & guidance disclaimer

Astrology, kundli, horoscope, remedy suggestions, AI outputs and related content are provided for general information, cultural interest or entertainment purposes. They are not a substitute for medical, mental-health, legal, financial or other professional advice.

Before taking important life decisions (health, marriage, career, investments, etc.), consult qualified professionals. Any reliance on Platform content is at your sole risk.

CosmicTalks does not warrant verification of any expert’s skills, credentials or background. Members are strongly encouraged to verify independently.

You release and hold harmless CosmicTalks and its affiliates, officers, employees and agents from claims arising from astrology, AI or consultation content accessed through the Platform.

4. Accounts, OTP & security

Some features require creating an account via mobile OTP or other means. Information you provide at registration must be accurate, complete and kept up to date.

• You are responsible for maintaining the confidentiality of your account, OTP, device and sessions.
• You are fully responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorised use or security breach.
• Do not use another person’s account without permission.

CosmicTalks will not be liable for losses arising from someone else using your account or OTP, with or without your knowledge.

5. Member conduct & use

By registering or using the Platform you represent and agree that:

• You are at least 18 years of age (or a legally recognised entity).
• You will not disrupt servers, networks or security, or attempt unauthorised access.
• You will not post or transmit unlawful, harassing, defamatory, obscene, racist, harmful or otherwise objectionable material.
• You will not send spam, malware, third-party ads, or content that infringes intellectual property.
• You will not violate applicable local, national or international law.
• You will not impersonate any person or entity.

CosmicTalks may, in its absolute discretion, remove violating content and suspend or terminate accounts.

You grant CosmicTalks a worldwide, royalty-free licence to use, reproduce, edit, transmit, display and create derivative works from content you submit, as needed to operate and improve the Platform.

6. Fees & payment

Many tools may be free. Paid consultations, premium features or other products may be offered at prices shown at checkout. Keep payment details accurate and ensure you are authorised to pay.

• You are solely responsible for all fees incurred under your account.
• Report payment gateway errors promptly; we will investigate and correct genuine mistakes where appropriate.
• Refunds, if any, are governed by CosmicTalks’s then-current refund practices and applicable law.

7. Intellectual property

The Sites, software, design, logos, text, graphics, databases and organisation are owned by CosmicTalks or its licensors. This Agreement does not grant you patents, copyrights, trademarks or other IP rights.

You may not reverse engineer, copy, modify or commercially redistribute source code, nor use confusingly similar marks or domain names.

CosmicTalks grants Members a limited, non-exclusive, revocable licence to use the Sites while fully compliant with this Agreement.

8. Privacy

By registering or using the Platform you also agree to our Privacy Policy, which explains how we collect, use and share personal information.

CosmicTalks may disclose Member information when reasonably necessary to comply with law, protect rights or property, investigate fraud, or enforce this Agreement.

9. Disclaimer of warranty & limitation of liability

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, CosmicTalks DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY AND ACCURACY.

CosmicTalks, its affiliates and their officers, directors, employees and agents shall not be liable for any direct, indirect, incidental, consequential, special, punitive or exemplary damages (including loss of business, revenue, profits, data or other economic advantage).

If applicable law does not allow the limitation above, liability will be deemed modified only as required by law, and CosmicTalks’s maximum aggregate liability will be capped at ₹500 or USD $10, whichever is higher.

10. Indemnification

You shall defend, indemnify and hold harmless CosmicTalks and its officers, directors, employees and agents from losses, damages, costs and reasonable attorneys’ fees arising from: (a) your breach of this Agreement; (b) content you submit or transmit; or (c) your use of the Platform.

11. Modifications & termination of services

CosmicTalks may modify or discontinue any service temporarily or permanently, with or without notice. We do not guarantee uninterrupted, timely, secure or error-free operation.

CosmicTalks may, in its sole discretion, terminate a Member’s participation and refuse current or future use of the Sites.

Links & advertisements

The Sites may contain third-party links or advertisements. CosmicTalks is not responsible for their content, products, privacy practices or any resulting transactions.

12. Miscellaneous, governing law & contact

This Agreement shall be interpreted in accordance with the laws of India (excluding conflict-of-law rules). Legal proceedings arising out of this Agreement shall occur exclusively in the competent courts in India.

You may not assign rights or obligations under this Agreement without CosmicTalks’s prior written consent. If any provision is held invalid, the remaining provisions remain in effect. This Agreement (and policies referenced herein) constitutes the entire agreement on the subject matter.
